Welcome to PomoDuck ("we", "our", "us"). These Terms of Service ("Terms") govern your access and use of the PomoDuck platform, including our website at pomoduck.com, our Telegram Mini App, and our WorldCoin Mini App. By using our services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old, or the minimum legal age in your country or jurisdiction, to use our services. By accessing PomoDuck, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.
2. Account Registration
When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. PomoDuck is not liable for any loss resulting from unauthorized use of your account.
3. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any part of the platform or other users' accounts
- Use automated bots, scripts, or other means to manipulate timers, leaderboards, or in-game rewards
- Harass, abuse, or harm other users
- Upload or transmit malicious code or interfere with platform infrastructure
- Misrepresent your identity or impersonate any person or entity
4. In-App Currency and Virtual Items
PomoDuck features virtual currencies (eggs and footprints) and collectible items. These virtual items have no real-world monetary value and cannot be exchanged for real money. We reserve the right to modify, suspend, or terminate virtual currency systems at any time. Any footprint packs purchased with real money are non-refundable except where required by applicable law.
5. Intellectual Property
All content on PomoDuck, including the duck characters, icons, artwork, interface design, and code, is the intellectual property of PomoDuck or its licensors. You may not copy, reproduce, distribute, or create derivative works based on our content without prior written permission.
6. Privacy
Your use of PomoDuck is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your data.
7. Third-Party Services
PomoDuck integrates with third-party services including Google, X (Twitter), Telegram, TON blockchain, and WorldCoin. Your use of these integrations is subject to the respective terms and privacy policies of those services. We are not responsible for the practices of third-party services.
8. Disclaimers
PomoDuck is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or free of viruses. Use of the platform is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by applicable law, PomoDuck and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of profits, arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.
10. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of PomoDuck shall be resolved through good-faith negotiation before pursuing formal legal action.
12. Changes to These Terms
We may update these Terms from time to time. We will notify users of significant changes via the website or email. Continued use of PomoDuck after changes take effect constitutes your acceptance of the revised Terms.
